BackgroundThe use of genetic test results in risk-rated insurance is a significant concern internationally, with many countries banning or restricting the use of genetic test results in underwriting. In Australia, life insurers’ use of genetic test results is legal and self-regulated by the insurance industry (Financial Services Council (FSC)). In 2018, an Australian Parliamentary Inquiry recommended that insurers’ use of genetic test results in underwriting should be prohibited. In 2019, the FSC introduced an industry self-regulated moratorium on the use of (...) genetic test results. In the absence of government oversight, it is critical that the impact, effectiveness and appropriateness of the moratorium is monitored. Here we describe the protocol of our government-funded research project, which will serve that critical function between 2020 and 2023.MethodsA realist evaluation framework was developed for the project, using a context-mechanism-outcome (CMO) approach, to systematically assess the impact of the moratorium for a range of stakeholders. Outcomes which need to be achieved for the moratorium to accomplish its intended aims were identified, and specific data collection measures methods were developed to gather the evidence from relevant stakeholder groups (consumers, health professionals, financial industry and genetic research community) to determine if aims are achieved. Results from each arm of the study will be analysed and published in peer-reviewed journals as they become available.DiscussionThe A-GLIMMER project will provide essential monitoring of the impact and effectiveness of the self-regulated insurance moratorium. On completion of the study (3 years) a Stakeholder Report will be compiled. The Stakeholder Report will synthesise the evidence gathered in each arm of the study and use the CMO framework to evaluate the extent to which each of the outcomes have been achieved, and make evidence-based recommendations to the Australian federal government, life insurance industry and other stakeholders. Diana Tietjens Meyers and Margaret Urban Walker argue that women's autonomy is impaired by mainstream representations that offer us impovenshed resources to tell our own stories. Mainstream picture books apprentice young readers in norms of representation. Two popufor picture books about child storyteüers present competing views of a child's authority to tell his or her own story. Hence, they offer rival models of the development of autonomy: neoAiberal versus relational. Theories of perception are at the core of many of the most renowned seventeenth and eighteenth century European philosophical systems. Work on perception is less common in the writings of women philosophers of this period, and yet, like their male peers, early modern women philosophers are responsible for innovative accounts of our perceptual relation with the natural world. With special attention to the work of Margaret Cavendish and Mary Shepherd, this essay explores some notable features of theories of perception (...) developed by women between the mid-seventeenth and the early nineteenth centuries with the aim of elucidating how women’s contributions to this cardinal area of early modern study expanded the diversity of views on offer. Many people accept, at least implicitly, what I call the asymmetry claim: the view that moral realism is more defensible than aesthetic realism. This article challenges the asymmetry claim. I argue that it is surprisingly hard to find points of contrast between the two domains that could justify their very different treatment with respect to realism. I consider five potentially promising ways to do this, and I argue that all of them fail. If I am right, those who accept the (...) asymmetry claim have a significant burden of proof. (shrink)

This article explores the psychological logics underpinning key perspectives in the ‘turn to affect’. Research on affect raises questions about the categorization of affective states, affective meaning-making, and the processes involved in the transmission of affect. I argue that current approaches risk depopulating affecting scenes, mystifying affective contagion, and authorizing questionable psychobiological arguments. I engage with the work of Sedgwick and Frank, Thrift, and Ahmed to explore these points and suggest that the concept of affective practice offers a more promising (...) social psychological grounding. Notions of affective practice are more commensurate with trends in contemporary psychobiology, explain the limits on affective contagion, and emphasize relationality and negotiation, attentive to the flow of affecting episodes. A practice approach positions affect as a dynamic process, emergent from a polyphony of intersections and feedbacks, working across body states, registrations and categorizations, entangled with cultural meaning-making, and integrated with material and natural processes, social situations and social relationships. In a 1955 lecture the physicist Richard Feynman reflected on the place of doubt within scientific practice. ‘Permit us to question, to doubt, to not be sure’, proposed Feynman, ‘it is possible to live and not to know’. In our contemporary world, the science of machine learning algorithms appears to transform the relations between science, knowledge and doubt, to make even the most doubtful event amenable to action. What might it mean to ‘leave room for doubt’ or ‘to live and (...) not to know’ in our contemporary culture, where the algorithm plays a major role in the calculability of doubts? I propose a posthuman mode of doubt that decentres the liberal humanist subject. In the science of machine learning algorithms the doubts of human and technological beings nonetheless dwell together, opening onto a future that is never fully reduced to the single output signal, to the optimised target. Religious capacity is a highly elaborate, neurocognitive human trait that has a solid evolutionary foundation. This book uses a multidisciplinary approach to describe millions of years of biological innovations that eventually give rise to the modern trait and its varied expression in humanity’s many religions. The authors present a scientific model and a central thesis that the brain organs, networks, and capacities that allowed humans to survive physically also gave our species the ability to create theologies, find sustenance in religious (...) practice, and use religion to support the social group. Yet, the trait of religious capacity remains non-obligatory, like reading and mathematics. The individual can choose not to use it. The approach relies on research findings in nine disciplines, including the work of countless neuroscientists, paleoneurologists, archaeologists, cognitive scientists, and psychologists. This is a cutting-edge examination of the evolutionary origins of humanity’s interaction with the supernatural. This article concerns a silver beaker (now at the Residenzmuseum, Munich) decorated with scenes which seem to be related to the Spanish conquest of Mexico. On the basis of stylistic, iconographic and archival evidence the silversmith is here tentatively identified with an Italian-born artist, Stefano Capello, who is thought to have added a decoration to a pre-existing beaker on the eve of the treaty of Cambrai (3 August 1529). Margaret of Austria, aunt of the emperor Charles V, might have (...) given the beaker as a gift to Louise of Savoy, mother of Francis I, king of France. The article argues, relying upon Warburg’s notion of Pathosformeln (formulas of emotion), that in the early 16th century the New World was perceived and made familiar through an Old World idiom, based on visual formulas taken from classical antiquity and mediated by the Italian Renaissance. There has been much recent debate about women's rights and their relation to human rights. Debates about domestic violence in Vanuatu are situated in this global frame but also in a regional and historical context dominated by the relation between kastom (tradition) and Christianity. This article depicts the dynamics of a conference on Violence and the Family in Vanuatu held in Port Vila in 1994, in terms of the competing claims of universal human rights and cultural relativism. The allegedly western (...) character of human rights which focus on the individual and civil and political rights is often contrasted with the non-western stress on collectivities and the rights to economic development and self-determination. These sorts of ideological oppositions in international politics reverberate in domestic politics as well, and especially in those which situate women and men as subjects in conflict, as they are in many domestic disputes. This article explains how 19th-century radical republicans answered the following question: how is it possible to be free in a social order that fosters economic dependence on others? I focus on the writings of a group of French thinkers called the solidarists who advocated “liberty organized for everyone.” Mutualism and social right were two components of the solidarist strategy for limiting domination in commercial/industrial society. While the doctrine (...) of mutualism was rooted in pre-industrial artisan culture, social right was a novel idea that built on Durkheim’s analysis of the division of labour. In this article, I describe the main features of the solidarist account: solidarity, social property, quasi-contractual debt, and restorative justice. Classical republicanism was deeply concerned with citizen participation and the balance between popular and elite power, but 19th-century radical republicans thought that these goals must be approached differently in market societies in which enormous power is exercised outside the state. The solidarists cautiously embraced the state as a mechanism for regulating the market in order to ensure equal liberty. Social right and mutualism were also conceived as ways of limiting the centralization of state power. (shrink)

This article uses a case-study of the relationship between the British suffrage organization, the Women's Social and Political Union, and its equivalent on the Irish side, the Irish Women's Franchise League, in order to illuminate some consequences of the colonial relationship between Britain and Ireland. As political power was located within the British state, and the British feminist movement enjoyed superior resources, the Irish movement was at a disadvantage. This was compounded by serious internal divisions within the Irish movement — (...) a product of the dispute over Ireland's constitutional future — which prevented the Franchise League, sympathetic to the nationalist demand for independence — from establishing a strong presence in the North. The consequences of the British movement organizing in Ireland, in particular their initiation of a militant campaign in the North, are explored in some detail, using evidence provided by letters from the participants. British intervention was clearly motivated from British-inspired concerns rather than from any solidarity with the situation of women in Ireland, proving to be disastrous for the Irish, accentuating their deep-rooted divisions. The overall argument is that feminism cannot be viewed in isolation from other political considerations. This case-study isolates the repercussions of Britain's imperial role for both British and Irish movements: ostensibly with a common objective but in reality divided by their differing response to the constitutional arrangement between the two countries. For this reason, historians of Irish feminist movements must give consideration to the importance of the ‘national question’ and display a more critical attitude towards the role played by Britain in Irish affairs. Clough's theological account of animals critiques the familiar negative identification of animals as not-human. Instead, Clough highlights both the distinctive particularity of each animal as created by God and the shared fleshly creatureliness of human and nonhuman animals. He encourages Christians to recognize Jesus Christ as God enfleshed more than divinely human, and consequently to care for nonhuman animals as those who share with human animals in the redemption of all flesh. This move risks downplaying the possibilities for creaturely specific (...) forms of redemption; limiting the cosmic efficacy of salvation in Christ; and losing the particularity of Christ's divine and human natures. Another, possibly less risky, direction to take Clough's insights about creatureliness and well-formed theological ethics might attend to the perverse ways that humans assess the worthiness of human and nonhuman animals by substituting particularities of use and abuse for the particularities of creation and salvation. This paper is based on the discovery of illustrated reports by French engineers describing their visits to the British Isles between 1783 and 1790, a brief period of peace between France and England after the ending of the American War of Independence. The manuscript reports are in the library of the Paris École des ponts et chaussées, which began to send students to Britain in the 1780s, but the engineers studied were of mature years and already well qualified. Two of (...) them, in fact, were the marine engineers Forfait and Lescallier, who brought samples and materials back to France for testing and experiment. They all wrote in great detail of what they had seen, and this included the coastline, ports and arsenals as well as industry. The reports are significant for the wealth of information they contain, which would be of immense value to a hostile power. The reasons for their being in the Ponts et chaussées library are considered. We examine the origins of that school, the engineers who came, their careers, their particular expertise, why they came to Britain, and the reports of their findings. Courts in the United States are finding that recipients can be bound by fine-print terms if they had notice of them. Without directly confronting the overarching normative question whether notice can cause contractual obligation, this Article takes notice seriously by focusing on how psychological characteristics of “HUMANs” suggest rethinking of when effective notice is likely to occur.

Judging Positivism is a critical exploration of the method and substance of legal positivism. Margaret Martin is primarily concerned with the manner in which theorists who adopt the dominant positivist paradigm ask a limited set of questions and offer an equally limited set of answers, artificially circumscribing the field of legal philosophy in the process. The book focuses primarily but not exclusively on the writings of prominent legal positivist, Joseph Raz. Martin argues that Raz's theory has changed over time (...) and that these changes have led to deep inconsistencies and incoherencies in his account. One re-occurring theme in the book is that Razian positivism collapses from within. In the process of defending his own position, Raz is led to support the views of many of his main rivals, namely, Ronald Dworkin, the legal realists and the normative positivists. The internal collapse of Razian positivism proves to be instructive. Promising paths of inquiry come into view and questions that have been suppressed or marginalised by positivists re-emerge ready for curious minds to reflect on anew.
